By engaging with Fifth Element services, offerings, or content you agree to these terms. They exist to protect the integrity of the work, the safety of participants, and the boundaries that make transformation possible.
1 Scope of Services
Fifth Element provides strategic consulting, somatic coaching, guided audio, workshops, retreats, and group memberships. Services are designed for transformation and impact. Offerings follow trauma-informed practice, ecological stewardship, and relational accountability.
2 Client Readiness and Conduct Expectations
Clients are expected to participate with clarity, commitment, and respect for the container. Members must engage in good faith, honor group agreements, and respect other participants’ dignity and boundaries. Unsolicited sales, repeated interruptions, or attempts to dominate group process are prohibited.
3 Values Alignment and Right to Decline or Remove
Fifth Element requires alignment with values of collective care, anti-extractive practice, and liberation-centered design. Fifth Element reserves the right to decline services or revoke membership without refund if a participant is misaligned, repeatedly violates boundaries, behaves abusively, or otherwise disrupts the safety of the group or the work. Reasons for removal include harassment, discrimination, persistent boundary violations, misuse of networking structures for unsolicited promotion, or refusal to engage with reasonable facilitator direction.
4 Structured Networking Expectations
Group calls include structured breakout activities intended to foster relational connection and responsible referral. Members are encouraged to share goals and follow up with peers after calls. Networking is relational not transactional. Misuse of networking spaces for aggressive solicitation or extraction may be treated as a breach of conduct.
5 Participation Standards for Group Calls
Group calls are interactive and designed for live participation. Members are expected to arrive prepared, to contribute respectfully, and to honor time-limited formats. Replays may or may not be provided at Fifth Element’s discretion. Attendance is optional but encouraged.
6 Coaching Access and Booking Policy
Each membership includes one 45-minute 1:1 session per billing cycle. Sessions must be booked within the billing cycle and do not roll over. Members may book additional sessions as permitted by membership terms and subject to availability. Booking windows, reschedule limits, and late cancellation policies apply.
7 Payment Cancellation and No Show Policy
Payment is due per the membership or service agreement. Cancellations require at least 48 hours’ notice for individual sessions and 7 days’ notice for group or organizational engagements. Late cancellations or no-shows may result in forfeited fees and may affect future booking eligibility except in cases of verified emergency or access-related need.
8 Confidentiality and Recording Policy
All session content and participant contributions in group spaces are confidential. Recording or distributing session content, materials, or participant contributions is prohibited without explicit written consent from Fifth Element and any affected participants.
9 Intellectual Property
All Fifth Element materials including frameworks, worksheets, recordings, guided audio, and curricula are the intellectual property of Fifth Element. Redistribution, replication, or unauthorized commercial use is prohibited without prior written permission.
10 Platform Use and Data Practices
External platforms used for booking, payment, or delivery are governed by their own terms in addition to these terms. Fifth Element selects platforms with robust ethical and data protection standards but cannot guarantee their performance or policies.
11 Limitation of Liability and Scope of Advice
Fifth Element is not responsible for outcomes outside the scope of coaching and consulting. Clients are responsible for their own decisions and integration. Coaching is not a substitute for medical, legal, or financial advice. To the extent permitted by law, Fifth Element’s liability for any claim related to services is limited to fees paid for the affected service.
12 Ecological and Relational Commitment
Fifth Element is committed to ecological repair and relational stewardship. Services are designed to honor interdependence, reject extraction, and support regenerative practice.
13 Amendments and Continued Engagement
Fifth Element may update these terms to reflect changes in services, platforms, or legal requirements. Continued use of services after notice constitutes acceptance of the updated terms.
